Emergency Response Plan (Sections301-303 of EPCRA) is required if your facility uses, stores or makes extremely hazardous substances (EHSs) in quantities above Threshold Planning Quantities (TPQs) as listed by the regulations.  Planning must be coordinated through the State Emergency REsponse Commission (SERC) and Local Emergency Planning Committees (LEPCs).

Community Right-to-Know reporting (Sections 311-312) is required if your facility makes, uses or stores chemicals that are considered hazardous under the OSHA hazard communication standard (requires a Material SAfety Data Sheet) and are present above certain reporting thresholds.

Annual Toxic Release Inventory Reporting (Section 313) requires submittal of a report of routine releases of hazardous chemicals by July 1st of each year.  This includes quantities of chemicals released n air, water, land, or transferred offsite.  Section 313 applies to facilities in Standard Industrial Codes (SICs) 20 through 39 that have 10 or more full-time employees and manufacture or process 25,000 pounds or use 10,000 pounds of more of a listed toxic chemical.  If your facility is covered, you must submit a Form R for each listed chemical.
